This is what’s happening in Wisconsin: lawmakers are moving two bills, Senate Bill 445 and Assembly Bill 446, to codify the IHRA definition of antisemitism into state law, allowing state power and public institutions to police our speech.

ADC strongly opposes SB 445 / AB 446, as they are unconstitutional and do not fill a legal gap. They are also unnecessary: Wisconsin already has strong hate-crime and anti-discrimination laws that protect Jewish communities and all targeted groups.

We’re not opposing them alone: In public testimony on October 22, nearly 9 out of 10 witnesses opposed these bills, including Jewish, Palestinian, interfaith, and civil liberties voices

Here’s what’s at stake:

  • IHRA was meant to be non-binding guidance, not a legally binding standard, but these bills would turn it into one. 
  • Most IHRA examples focus on Israel, blurring political critique with discrimination claims.
  • Criticism of any government, including Israel, becomes a punishable offense.
  • Even IHRA’s lead drafter, Kenneth Stern, warns codifying it invites weaponization against dissent.
